Well-known Mark of “LIUYANG FIREWORKS”

On behalf of Liuyang Association for Smoke Flowerage and Firecracker, Andu & Partners raised an opposition against the trademark application of “LIUYANG FIREWORKS” and Design No.3922494. We also requested for determining the trademark of “LIUYANG FIREWORKS” as a well-known mark in China.

Finally, the Chinese Trademark Office determined that the trademark of “LIUYANG FIREWORKS” is a well-known mark under the goods of smoke flowerage and firecracker in China, owing to its use in years and good reputation in the relative public. In the meantime, the Chinese Trademark Office decided to reject the opposed trademark application under the goods of smoke flowerage and fireworks in class 13, due to the similarity to the mark of “LIUYANG FIREWORKS” in name of Liuyang Association for Smoke Flowerage and Firecracker.
